At any given time, compliance poster requirements can change or posters may require updates on the federal, state, or local levels. As an employer, keeping up with all these changes can become difficult and overwhelming while focusing on managing a business. Justworks helps ensure that your posters are receiving the attention they deserve.*
Do I need a labor law posters?
All employers with at least one employee must post all applicable federal, state, and local labor law posters.
What if my company has multiple office locations?
Companies with multiple office locations should have the correct set of labor law posters accessible to employees at each location. Posters should be displayed prominently and in highly trafficked areas at each office. Employers are still required to provide employees with the correct set of labor law posters, based on their work location. Remote poster services enable these employees to view the applicable labor laws posters online.
The U.S. Department of Labor (DOL) has recently provided updated guidance on complying with its notice and posting requirements when employees are working remotely in light of the COVID-19 pandemic. Other federal agencies and various state and local agencies may have additional guidance on complying with posting requirements.
What about my employees who work remotely?
Employers are still required to provide employees with the correct set of labor law posters, based on their work location. Remote poster services enable these employees to view the applicable labor laws posters online.
For questions on how your employees should be classified, between working in the office or working remotely, please consult your external legal counsel on how to navigate your company’s return to work strategy. For payroll tax reasons, many jurisdictions may require that you continue to apply taxes based upon an employee’s regular office location rather than their home location if such employees are only temporarily working remotely due to COVID-19 or other reasons. To do this in Justworks, such employees should not be marked as “remote” on the Justworks platform.
How can I start or end service with Poster Guard® by ComplyRight?
Each October, you’ll be able to change your company’s Compliance Poster Settings for an annual subscription of mandatory updates. New subscriptions will receive a full set of Federal, State and local labor law posters, while repeat subscriptions will continue to receive updates throughout the year.
To change your Compliance Poster setting, simply navigate to Company > Settings in your Justworks account, and toggle your options for Office and Remote posters under ‘Compliance Poster Settings’.
Note: If you’d like to opt-in outside of this timeline, you will need to contact support@justworks.com in order to create an order for Poster Guard® by ComplyRight.
What are compliance poster renewals?
Justworks operates on a subscription model with a same-date renewal for all active subscriptions. Your company has a subscription for each office location and each remote employee. Your yearly compliance poster subscription renews in October when you will be charged per location and per remote employee for each subscription.
The subscription ensures that each of your office locations and remote employees will continue to receive updates to your posters to keep up with changes to federal, state, and local requirements.
How does billing work?
The annual subscription fee is billed per office location ($46.50/location) and per remote employee ($10.50/remote employee).
For example:
If you have 4 office locations and 6 remote employees, you’d be charged:
(4 offices * $46.50) + (6 remote employees * $10.50) = $249.00 annually
The only time you will see additional costs throughout the year is when you add a new office location or remote employee after the annual renewal date. Your account would then be automatically charged a prorated rate for those new office locations or remote employees. All new locations and remote employees will be included in the renewal for the following year.
How do I prepare for compliance poster renewal?
To ensure you are billed correctly for the appropriate office locations and remote employees, we ask that you:
1) Check that Remote Employees are correctly labeled as such in Justworks. You can do this under Manage > Employees > Select Employee > Job Information > ‘Edit’ > switch to “Remote (work from home).
2) Check that all Office Locations are listed correctly in Justworks and are physical locations. You can do this under Company > Settings > Offices. You can add, edit, or remove offices on this page. We recommend you click into each listed office to double-check the address for accuracy.
Notes
*The poster sets provided by Poster Guard® by ComplyRight do not include industry-specific posters, posters that employers are required to obtain on their own directly from the issuing agency, posters that employers need to develop on their own reflecting their specific policies and practices, and posters that federal contractors are required to obtain relating to requirements specific to federal contractors.
